Abstract
Apres les etudes de L. Mitteis (1891), qui ont prouve la continuite
du droit grec depuis Pantiquite jusqu’au commencement du
XIXe siecle, les historiens ont pris l’habitude de distinguer le droit
byzantin du droit post-byzantin. Ils ont meme considere ce dernier
droit comme quatrieme periode du droit grec, en le qualifiant : «droit
grec apres la prise de Constantinople par les Turcs». I/A. prefere le
titre de «droit post-byzantin», parce que ce terme designe, en meme
temps, le droit des provinces ex-byzantines, tombees, avant ou apres
1453, sous la domination franque, venitienne, turque, etc. Les sources
du droit post-byzantin etant en grande partie inedites et, par le fait
meme, les coutumes judiciaires des provinces grecques etant imparfaitement
connues, PA. dresse un tableau chronologique des sources,
editees ou inedites, afin de faciliter et d’encourager les recherches.
